General Sales Conditions

1. Object
The general conditions of sale are intended, first, to inform any potential consumer on the terms and conditions under which the seller makes the sale and delivery of products ordered, and secondly, to define the rights and obligations of the parties in connection with the sale of goods by the seller to the consumer.

Our sales are subject to these terms and conditions which prevail over any conditions of purchase, unless otherwise formal and express our part.

These conditions apply, without limitation or qualification, to all sales by SARL Galoupet Wines Collections, the products offered in these sales directly or indirectly, by fax, mail, telex, email and any other medium.
Consequently, for any person to order a product offered for sale by SARL Galoupet Collections Wines wins full acceptance of these terms and conditions of sale which the Buyer acknowledges having read before ordering.
The products are offered for sale on the following geographic territory: Metropolitan France, excluding overseas territories and export. For export and overseas territories, please contact us.
Buyer prior to his order, states have full legal capacity, allowing it to engage under these terms and conditions of sale.
The Wines Ltd. Galoupet Collections reserves the right to change at any time these terms and conditions of sale.

3. Formation of the contract and orders
3.1. Price
The selling prices of products in Euros, are those in effect at the time of registration of the order by the Buyer.
The selling price of products can be modified by SARL Galoupet Wines Collections at any time. This change will be reported to the Buyer before any order.

3.2. Product features - Availability - Shipping
Pursuant to Article L 111-1 of the Consumer Code, the Purchaser may, prior to his order, take note, with the Wines Ltd. Galoupet Collections, the essential characteristics of the product they wish to order.
The offers presented by Wines Ltd. Galoupet Collections are valid while stocks last.
The Wines Ltd. Galoupet Collections reserves the right to change the product mix according to particular constraints on business.

The Buyer's order must be confirmed by the LLC Galoupet Wines Collections, email, mail or fax.
The sale will be considered final after the shipment to the Buyer of the order confirmation by SARL Galoupet Wines Collections.
SARL Galoupet Collections Wines recommends that the Buyer retains this information on a paper or computer.

3.4. Payment of the price.
All orders are payable in Euros.
To set the order, the Buyer has all the payment methods specified in the order form: credit card (credit card, Eurocard, Mastercard, Visa) and bank check.
The Buyer warrants to the LLC Galoupet Collections Wines that have the required permission to use the payment method he chose, when recording the purchase order.
The Wines Ltd. Galoupet Collections reserves the right to suspend or cancel any orders and / or delivery, whatever their nature and level of performance, for non-payment of any sum due by the Buyer or incident of payment.
Penalties in an amount equal to the legal interest rate plus five points are automatically applicable to amounts outstanding at the end of a period of ten days from the invoice date or upon notification of the rejection of bank payment other means of payment. The delivery of any new order may be suspended in case of late payment of a previous order, notwithstanding the provisions hereof.
As part of the fight against Internet fraud, the details of your order may be passed to any third party for verification.

NB: The Wines Ltd. Galoupet Collections accepts checks - in euros only - drawn on a bank whose office is located on French territory only.


3.5. Choice of products
The Buyer has read the products and their characteristics, sold by the SARL Galoupet Collections Wines, has sole responsibility and according to his needs as he has previously laid down before any order, focused on his choice or products covered by the order.

3.6. Shipping and Receiving

3.6.1 General Rules
Products will be delivered to the address specified by the Purchaser on the order in France.
NOTE: Orders will not be processed for delivery addresses containing only a PO Box (BP).
The Purchaser may, at his express request, obtain the sending of the invoice to the billing address and not the delivery address by validating the option provided for this purpose on the order form.
In case of partial availability of items, SARL Galoupet Collections Wines will be required to separate the commands. Thus the available items may be sent initially, the balance of the order will be sent when all other items will be available.
Lack of compliance with the procedures set forth below, no claim of the Buyer will be accepted.

3.6.2 Characteristics of delivery.
Buyer is delivered to the address on the purchase by the transport service within 6 days after the fair ordering (excluding weekends and holidays) and sign a slip distribution acknowledgment. If no, the driver will represent the package twice. We recommend to provide a telephone number to arrange an appointment.
Buyer must verify, in the presence of the deliveryman, the state of the packing of the goods and content delivery.

In case of damage, you must state accurately your reservations on the delivery note, and reiterate to the carrier by registered letter with acknowledgment of receipt within three 3 days of delivery in accordance with Article L.133- 3 of the Commercial Code.
You must also inform us by registered letter with acknowledgment of receipt of any shipping damage within eight eight days of receipt. No claims will be accepted for failure to comply with these formalities.

3.6.3: Time
The average time at the start of the filing of the LLC Galoupet Wines Collections are:

3.6.4: Quality Issues and Compliance
If delivery of a product does not correspond to the order (defective or non-compliant), Buyer must make its claim within 7 days of signing the slip distribution.
Claims must be sent by registered letter with return receipt to the address given in paragraph 2 hereof and shall include:

• Product references.

The return of products must be made within seven working days after the awarding of a number of return by customer service of the LLC Galoupet Wines Collections.

Shipping costs are the responsibility of the buyer. You are free to choose the shipping method and purchase insurance or not in case of loss, theft or destruction of your package. We do support any of these charges and can not be held responsible for non receipt of your package.
Any risk associated with the return of the product is borne by the Buyer.
Failure to comply with the procedure outlined above and the time specified, Buyer may not make any claim for nonconformity or defect of the delivered products, the products then being deemed compliant and free of any visible defect.

3.7. Product Availability
In case of unavailability of the product ordered, SARL Galoupet Wines Collections notify Buyer at the earliest.

3.8. Retention of title
The Wines Ltd. Galoupet Collections retains full ownership of goods sold until full payment is received, in principal, costs and taxes.
During the period between delivery to the transfer of ownership, the risk of loss, theft or destruction shall be borne by the buyer.
The failure by the buyer of his obligations of payment gives the seller the right to demand the immediate return of goods delivered to the expense and risk of Buyer.

3.9. Warranty.
No returns will be accepted without prior authorization of the LLC Galoupet Wines Collections.
If the product is identified as defective, SARL Galoupet Collections Wines send the buyer a product return number. 39.1. The LLC does not guarantee Collections Galoupet Wines Buyer under latent defects affecting the products delivered, as part of a replacement of defective products, making them unfit for consumption, without being considered by Buyer as responsible for any harmful consequences that could result in hidden defects.

39.2 Responsibility

The products offered by the LLC Galoupet Collections Wines comply with French legislation.
The Wines Ltd. Galoupet Collections can not be held liable for breach of contract if out of stock or product unavailability, force majeure, disruption or total or partial strike of transport services and / or email.
The Wines Ltd. Galoupet Collections can not be held liable for any damages that may arise from the purchase of products.
The total or partial inability to use the products, mainly because of a defect, rendering it unfit for consumption can not engage the responsibility of the LLC Galoupet Wines Collections or give rise to any compensation or refund, unless specific agreement Wines SARL Galoupet Collections.

3.10. Partial invalidity
If one or more provisions of these terms of sale are held to be invalid or declared as such under any law, regulation or following a final decision of a competent court, other provisions shall remain full force and effect.

3.11. No waiver

3.12. Governing Law
These general conditions of sale are exclusively governed by French law, which is subject SARL Galoupet Wines Collections, to the exclusion of any other law including the Vienna Convention of 11 April 1980 on the International Sale of Goods.

3.13. Data Protection

SARL Galoupet Collections Wines does not sell, ready, does not transfer any file with the name and address of its customers.

3.15. Jurisdiction

Any dispute relating to this sale, even if the warranty claim or multiple defendants, would be in default of agreement, the exclusive jurisdiction of civil courts in whose jurisdiction is the domicile of the seller.
